MyLegacyBinder Terms of Use (Revised)
1. Agreement to Terms
These Terms of Use form a binding agreement between you and Teknicorp, LLC, doing business as MyLegacyBinder. By using the Platform, you agree to these Terms. We may update these Terms periodically, and continued use constitutes acceptance of revised Terms.
2. Purpose of the Platform
MyLegacyBinder provides tools for organizing, storing, and managing personal, financial, and legacy-related information.
3. Age Requirements
You must be at least 13 years old to use the Platform.
4. Intellectual Property
All software, text, graphics, and materials are owned or licensed by Teknicorp, LLC.
5. User Accounts
You are responsible for safeguarding your account credentials and all activity under your account.
6. Privacy and Security of Uploaded Documents
Protecting your privacy is a core principle of MyLegacyBinder. Uploaded documents are encrypted using security measures designed to prevent unauthorized access. Under normal operation of the Platform, Teknicorp does not have access to the contents of users’ encrypted documents. We do not review document contents for advertising or marketing purposes. Access by designated contacts occurs only in accordance with permissions and trigger conditions established by the account owner.
7. User Conduct
Users may not bypass security, upload malware, harass others, scrape data, or engage in unlawful activity.
8. User Contributions
Feedback may be used to improve the Platform. Uploaded encrypted documents remain under user control.
9. Platform Management
We may monitor system performance and security to protect the Platform.
10. Service Availability
We strive for reliable service but cannot guarantee uninterrupted availability.
11. Data Backup and Recovery
While we implement reasonable safeguards and backup procedures, users are responsible for maintaining copies of important documents. MyLegacyBinder is not liable for data loss resulting from hardware failures, software defects, cybersecurity incidents, force majeure events, or user actions.
12. No Professional Advice
MyLegacyBinder is an organizational and document-management platform only and does not provide legal, financial, tax, insurance, investment, or estate-planning advice.
13. Suspension and Termination
We may suspend or terminate accounts that violate these Terms, create security risks, or threaten the integrity of the Platform.
14. Governing Law
These Terms are governed by the laws of the State of Texas.
15. Dispute Resolution
Disputes shall be resolved through binding arbitration. Users waive participation in class-action proceedings to the extent permitted by law.
16. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, government actions, internet outages, cyberattacks, labor disputes, or third-party service failures.
17. Disclaimer
The Platform is provided as-is and as-available without warranties to the fullest extent permitted by law.
18. Limitation of Liability
To the maximum extent permitted by law, neither party shall be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost business opportunities, or loss of data. Our total liability shall not exceed the amount paid by you during the six months preceding a claim or $1,000 USD, whichever is less.
19. Indemnification
You agree to indemnify and hold Teknicorp harmless from claims arising from misuse of the Platform or violation of these Terms.
20. Intellectual Property Complaints
Claims of copyright or intellectual property infringement may be submitted to the Company for review.
21. Data Retention
You may delete your account and documents at any time, subject to operational retention and backup procedures.
22. Survival
Provisions relating to intellectual property, privacy, indemnification, limitation of liability, dispute resolution, and similar obligations survive termination.
